Negative Media awaits NCDP over Messy Divorce if Faison elected Chair

Rep. Faison's wife files abandonment claim
September 01, 2010 9:03 AM

HILLSBOROUGH — Lindy Faison, the wife of N.C. Rep. Bill Faison,
filed a complaint for post-separation support, alimony and equitable distribution in Orange County Civil Superior Court on Tuesday.

She contends that her husband abandoned the marital home, leaving her without money but the responsibility for the care of 30 horses that he bred.

Bill Faison, a Democrat who is serving his third term as a representative of Orange and Caswell counties in the N.C. House of Representatives, did not return phone calls and an e-mail asking for comment. He is running for re-election against Republican challenger Richard Rex Smith in the general election on Nov. 2.

“The Defendant, who is a millionaire many times over, has willfully failed to provide necessary subsistence to the Plaintiff according to his means and condition, so as to render the Plaintiff’s condition intolerable and her life burdensome,” the complaint states.

Bill Faison is a partner in Faison & Gillespie, which advertises itself as one of the largest plaintiffs medical malpractice groups in the state.

The complaint details the failure of the Faisons’ marriage, in which Lindy Faison states that she and her husband had a good marriage in the beginning but after having four children in five years, Bill Faison “complained and ridiculed the Plaintiff for being exhausted physically after taking care of four young children and thirty horses all day long.”

“The Defendant’s actions of cutting Plaintiff off emotionally caused the Plaintiff great emotional distress and pain,” the suit states.

Lindy Faison contends her husband had an affair with a waitress at a Chinese restaurant in Durham in 2002, which he promised to end, but the complaint states that Lindy Faison believes he has continued to pursue other women. The complaint offers no proof of her contention.

She also accuses him of looking at pornography three times at their home.

Lindy Faison states that her husband left her with a sizeable tax debt for 2009, when he filed a separate tax return, which she had no means to pay.

She also accuses him of repeatedly sending her the bill for unpaid real property taxes for a lake home that was in both their names.

Lindy Faison believes her husband “took these actions in order to inflict extreme distress on the Plaintiff and to put her under intolerable financial pressure, and he succeeded in doing so, because his actions jeopardized the only two assets on which the Plaintiff had her name.

Lindy Faison asks for an award of post-separation support, alimony, and unequal distribution of marital and divisible property in her favor and attorneys’ fees and costs.
